These Terms of Service (“Terms”) govern your use of Airau’s website, AirauApp CRM, automation tools, marketing services, and any other products or services we provide (“Services”).
By using our Services, you agree to be bound by these Terms.


1. Use of Services

You agree to:

  • Use our Services only for lawful purposes
  • Not engage in abusive, fraudulent, or misleading behavior
  • Provide accurate business information
  • Maintain confidentiality of login credentials
  • Comply with all messaging, email, and privacy regulations

You are responsible for any activity occurring under your account.


2. Client Responsibilities

Clients using Airau or AirauApp must:

  • Obtain proper SMS opt-in consent from their contacts
  • Upload only compliant contact lists
  • Not send spam, unlawful content, or abusive messages
  • Ensure adherence to CASL, TCPA, A2P rules, and other regulations
  • Provide timely content and approvals for marketing projects

Failure to comply may result in suspension of services.


3. Service Fees & Payments

  • Fees are billed as outlined in your service agreement or subscription plan
  • Payments are due on the schedule listed in your invoice
  • Late payments may result in service suspension
  • All fees are non-refundable unless required by law

4. Intellectual Property

All creative assets produced by Airau—including websites, videos, graphics, copywriting, automations, and technical builds—remain the property of Airau until payment is completed in full.

Airau retains the right to display completed work in portfolios unless otherwise agreed.


5. CRM & Automation Data

By using AirauApp, you grant Airau permission to store, process, and manage:

  • Customer data
  • Message logs
  • Automation workflows
  • Lead information
  • Appointment data

You are solely responsible for ensuring you have legal rights to upload contact lists.


6. SMS, Email & Marketing Compliance

You agree to:

  • Collect proper consent
  • Use unsubscribe links
  • Provide accurate sender identification
  • Not use the platform for unsolicited messaging
  • Follow all relevant laws

Airau is not liable for penalties or damages arising from improper use of messaging tools by clients.


7. Termination

We may terminate or suspend your access if:

  • Payments are overdue
  • You violate these Terms
  • You misuse messaging tools
  • You engage in fraudulent activity

You may terminate services at any time by emailing: support@airau.ca.
No refunds are provided for unused subscription periods.


8. Limitation of Liability

To the fullest extent permitted by law, Airau is not liable for:

  • Lost profits
  • Business interruption
  • Data loss
  • Indirect or consequential damages
  • Penalties from improper client use of messaging tools

Our total liability is limited to the amount paid for Services in the previous 3 months.


9. No Guarantees

Marketing, advertising, and automation services inherently carry uncertainty.
Airau makes no guarantees related to:

  • Revenue growth
  • Lead performance
  • Ad results
  • Search rankings
  • Customer acquisition

We provide professional best-effort services.


10. Governing Law

These Terms are governed by the laws of Alberta, Canada.
Any disputes will be resolved in Alberta courts.


11. Updates to Terms

We may update these Terms at any time.
Continued use of the Services constitutes acceptance of the updated Terms.
